The Board of Commissioners aimed to create a policy to ensure information requests filed with county departments are processed correctly and in line with the requirements of Indiana's Access to Public Records Act, but the plan immediately drew questions about its need and the motivation behind the change. The policy shift was partially backed by arguments that information requests from the public are occasionally not processed in a timely manner and an audit prepared by a county consultant just released Friday at the request of the Post-Tribune after access to the document was initially denied. The county at first weighed funneling all records requests through the Board of Commissioners but has since decided to have each department designate two people who will be in charge of processing and fulfilling those requests. "I don't feel like it was a big change to policy," said Commissioner Mike Repay, D-Hammond. "It's just a slight adjustment." As requests go into the offices with different people handling them, Repay said not having a policy on what to do can cause problems. "Now we have one in writing," Repay said. "Hopefully, that's one that gets followed correctly." If the county fails to respond to public-records requests, it will pay for that either through reputation or financially, Repay said. "Our function is limiting liability," Repay said. A memo that had been distributed to county department heads said all information requests would go to the commissioners' office, based on the recommendation of the commissioners' attorney and an internal audit. The Post-Tribune requested the internal audit, prepared by Tramel Raggs, a consultant for the board, on April 17 but was refused, with the county citing disclosure exemptions that it's both privileged and deliberative material both discretionary exemptions. Indiana's Access to Public Records Act allows for records exempted under the attorney-client privilege or deliberative material provisions to be released with any sensitive passages redacted.
